1. Acceptance of Terms
By accessing or using the PreQual™ platform at prequal.au, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform. These terms constitute a legally binding agreement between you and PreQual™ (ABN to be confirmed).
2. Description of Service
PreQual™ operates a lead qualification platform that collects and assesses information from prospective home buyers, generates a qualification score, and (where a buyer qualifies) shares buyer profiles with registered Australian residential builders. The platform is provided to:
- Buyers — to be assessed for readiness and matched with builders
- Builders — to receive verified, qualified buyer leads under a performance-based commercial agreement
3. Eligibility
You must be 18 years or older and an Australian resident (or have lawful authority to enter binding contracts in Australia) to use the platform. By submitting your details, you represent that the information you provide is accurate and complete.
4. Buyer Qualification Flow
Buyers who complete the qualification flow understand and agree that:
- PreQual™ may share their profile (including financial position, location preference, budget, and contact details) with matched builders registered on the platform
- A qualification score is generated algorithmically and does not constitute financial advice
- Documents submitted (pre-approval letters, proof of funds) will be stored securely and used solely to verify qualification status
- Builders may contact them directly following a successful match
5. Builder Commercial Terms
Builders who register on PreQual™ are subject to a separate commercial agreement. Key principles include:
- No setup fees or monthly retainers
- A 3% success fee applies on the contract value when a matched buyer signs a build contract
- Attribution is tracked via PreQual™ tracking technology; disputes must be raised within 30 days of contract execution
- Builders must not circumvent PreQual™ tracking or share buyer information beyond their own sales process
6. Intellectual Property
All content, design, software, and data on the PreQual™ platform is owned by or licensed to PreQual™ and is protected by Australian copyright law. You may not reproduce, distribute, or create derivative works without prior written consent.
7. Prohibited Conduct
You must not:
- Submit false or misleading information in the qualification flow
- Attempt to circumvent our qualification scoring or tracking systems
- Use automated means to access or scrape the platform
- Use the platform for any unlawful purpose
- Harass, abuse, or threaten other users or staff
8. Disclaimer of Warranties
The platform is provided on an “as is” basis. PreQual™ makes no warranties, express or implied, regarding the accuracy of qualification scores, the suitability of any builder match, or the availability of the platform. We do not guarantee that any buyer will be matched with a builder or that any builder will sign a contract with a matched buyer.
9. Limitation of Liability
To the maximum extent permitted by Australian law, PreQual™ is not liable for any indirect, incidental, special, or consequential loss arising from your use of the platform. Where liability cannot be excluded, it is limited to the resupply of the relevant service or AUD $100, whichever is less.
10. Australian Consumer Law
Nothing in these Terms excludes rights or remedies available under the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law) that cannot be lawfully excluded.
11. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland.
13. Changes to Terms
We may update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
